The Charlotte Housing Authority is facing privacy concerns in the wake of a federal proposal to ban smoking in all public housing buildings.

Cheron Porter, the agency’s director of public relations, said compliance with the law is difficult when the agency requires residents to limit what they can do in their homes when smoking is not illegal.
“You’re talking about someone who chose to do this activity,” Porter said. “How do you tell someone what to do in their house?”
The Department of Housing and Urban Development on Thursday released a proposal banning smoking in all public housing buildings across the country. Smoking will be prohibited in all apartments, common areas and all outdoor areas within 25 feet of residential and administrative buildings.
Since HUD began banning smoking in public housing in 2009, more than 600 agencies representing more than 200,000 households have voluntarily banned smoking indoors. In Charlotte, five public housing units — four 670-unit housing developments and an administration office on East Boulevard — have been smoke-free since 2009, Porter said. The agency has 39 residential developments.
Smoke-free apartments are high-rise buildings where residents have been forced to relocate temporarily after several renovations. When they returned, they said the no-smoking policy was in their new lease. Smoking is now only permitted in designated areas at these sites.

“We don’t have the police to check if residents are breaking the no-smoking laws,” Porter said. “If we can walk down a hallway and smell it, we’ll know. If we walk into your unit and it smells like a chimney, we’ll know.”
And there are consequences. Violators will receive a verbal warning first; The second time they get the written one with the resource materials. For fourth violations, residents can be booted from their homes and pay a $250 cleaning fee.
